McAlpine & Associates garners $12 million in judgment for construction client

Verdict among largest in Michigan history


A Wayne County Circuit Court jury recently rendered a verdict of $12,000,000 in favor of Wayne Oakland Contracting Inc., a construction company represented by McAlpine & Associates. The judgment in WAYNE OAKLAND CONTRACTING INC. V. CITY OF GARDEN CITY, ranks as one of the top five Michigan jury verdicts in 2002. The jury concluded the municipality had defrauded Wayne Oakland Contracting and was in breach of contract. Specifically, the city was found to have interfered with work throughout the project's life span while not paying for changes in the project scope or for architectural design defects.

JUDGMENTS

  • McAlpine & Associates is currently representing the largest U.S. freight airline as a Plaintiff in design defects litigation pending before the Federal District Court in the Northern District of California arising out of the design of modifications to B747 aircraft. McAlpine & Associates obtained jury verdict in excess of $120,000,000 based on breach of contract and fraud claims.
  • McAlpine & Associates served as lead trial counsel in the defense of $30,000,000 claim made under the Federal False Claims Act in connection with the award and later settlement of the government procurement contract in excess of $1,000,000,000
  • A firm principal served as mediator in a dispute between a large commercial development company and a major oil company concerning the damages caused by a fuel release and the resultant environment remediation project. The parties had presented claims in excess of $3,000,000 and had been unable to settle the dispute after several years of active litigation. The matter was settled after a half day of mediation.
